I’m a business lawyer representing small to medium-sized enterprises and family offices in the Colorado, US, and international markets. I also represent companies in all aspects of the legal cannabis sector, including industrial hemp, adult use marijuana, medical marijuana, and ancillary companies.
In 2018, I founded Adam Foster Law to focus on outside general counsel legal work, business and governmental consulting, and alternative dispute resolution. Before founding my firm I was a partner at Hoban Law Group, where I worked for eight years.
I have been at the forefront of defining better practices for lawyers representing cannabis companies and have presented on legal ethics and core competencies for cannabis lawyers for many years. In 2018, I led the first circle mentoring group focusing on skill building and professional longevity for cannabis attorneys. The circle is sponsored by the Colorado Supreme Court’s Colorado Attorney Mentoring Program, and I believe it is the first court-sponsored mentoring program in the nation for cannabis lawyers.
I began practicing law in 2004 as a litigator at the Denver office of a national insurance defense firm and have spent thousands of hours managing a wide variety of litigation matters and appeals. I have successfully represented clients as lead counsel in numerous bench and jury trials. Over time, I realized I could more effectively help my clients reach their goals by focusing on business planning. My deep litigation experience continues to help me get my client’s message across, to counsel business clients on risk mitigation, and to work as a mediator to help other parties resolve their disputes.
Practice areas and representative matters include the following:
Forming new entities, drafting corporate governing documents and employment agreements, and negotiating commercial leases;
Helping clients to buy and sell real estate, business assets, and entire companies;
Drafting industrial hemp purchasing and processing agreements;
Mediating business disputes;
Helping an Australian manufacturer of industrial water tanks form a US subsidiary to purchase its Texas-based distributor in order to control its supply chain and boost sales in the US;
Acting as an expert witness for the Nevada Department of Transportation in a case involving the eminent domain acquisition of a medical marijuana cultivation facility;
Representing a lender issuing multimillion dollar loans to cannabis businesses;
Advising the Board of County Commissioners of Mesa County, Colorado on streamlining the Mesa County Land Use Code; and
Acted as lead counsel in suit before the Denver District Court and Colorado Court of Appeals challenging Colorado Board of Health’s denial of Petition to add PTSD as a recognized condition for medical marijuana recommendations; later testified extensively before the Colorado General Assembly and supported lobbying effort to successfully pass SB 17, which added PTSD as the first new medical condition recognized since passage of Amendment 20 to the Colorado State Constitution in 2000.
Keenan M. Jones
Keenan represents businesses of all sizes in litigation matters, corporate formation, business development, and protection of intellectual property rights. Since 2017, he has focused his practice on assisting companies operating in the regulated cannabis space, including hemp, marijuana, and ancillary endeavors.
Before co-founding Foster & Jones, Keenan worked at the Hoban Law Group, where he guided businesses in the emerging cannabis industry. Prior to that, Keenan learned the intricacies of the foreclosure process at the Indiana Housing & Community Development Authority, litigated business disputes at Lewis Wagner, and represented insurance carriers and surety providers at the Hustead Law Firm.
Keenan works closely with clients to determine their ultimate objective and counsels them at every step to ensure that objective remains in sight. A few of his accomplishments include:
Litigating a number of cases to judgment;
Successfully negotiating numerous settlements prior to trial;
Successfully protecting the constitutional rights of a local developer;
Assisting with the eviction of defaulting, commercial tenants;
Working with municipal governments to ensure the transfer of regulated marijuana licenses;
Helping structure new businesses to best facilitate cannabis operations; and
Guiding hemp businesses through the federal trademark process by submitting USPTO applications and responding to office actions.
Keenan is licensed in Colorado and Indiana. A midwestern native, Keenan splits his time between Denver and Indianapolis and enjoys spending time with his wife Regan, daughter Maisie, and dog Franklin.
